NARAL Pro-Choice Texas, the League of Women Voters of Texas, and other pro-abortion organizations are attacking this bill.

The bill was introduced at the Capitol news conference featuring abortion survivor and Austin resident Claire Culwell. Bill author Rep. Jeff Leach said:

BACKGROUND
- The Texas Born-Alive Infant Protect Act seeks to give legal protection to babies born alive after an abortion or attempted abortion. In 1995, the Legislature passed a bill to recognize that a child born after an abortion has the same rights and privileges as any other child born alive. However, that law has no enforcement. In 2002, the Congress passed a similar measure, again without any enforcement.
- HB 16 is authored by State Rep. Jeff Leach (R-Plano), and the nearly identical Senate companion SB 23 is authored by Sen. Lois Kolkhorst (R-Brenham).
- It is hoped that HB 16 will be scheduled for consideration on the House floor soon after the hearing on Monday. They it will go to the Senate, which has already had a successful hearing on SB 23 in the Senate Health and Human Services Committee, chaired by the author Senator Kolkhorst.
