WASHINGTON, D.C. — Texas Alliance for Life strongly supports the Safeguarding Women from Chemical Abortion Act, introduced by U.S. Senator Josh Hawley (R-Mo.) with companion legislation introduced in the U.S. House by Congresswoman Diana Harshbarger (TN-01). The bill would withdraw the FDA’s approval of mifepristone for abortion, make its distribution for abortion a violation of the Federal Food, Drug, and Cosmetic Act, and create a private right of action for women harmed by the drug to sue its manufacturers.

Senator Cornyn’s backing of the Safeguarding Women from Chemical Abortion Act reflects the same principled commitment to protecting women and unborn children that has defined his service in the United States Senate,” said Texas Alliance for Life Executive Director Amy O’Donnell.
A recent study found that one in seven women who use mifepristone experience sepsis, infection, hemorrhaging, an emergency room visit, or another serious adverse event within 45 days. Evidence indicates that these complications became even more common after key safety measures, including in-person physician visit requirements, were eliminated by the Biden administration. Women have suffered permanent loss of fertility, life-threatening hemorrhage, and death. The unborn children these drugs are distributed to destroy are also victims.
In Texas, the lives of unborn children are protected from conception under the Human Life Protection Act, with steep penalties for those who provide or perform abortions illegally, and HB 7, passed in the 89th Legislative Session, added additional enforcement tools against the illegal trafficking of chemical abortion drugs into our state. The FDA’s pills-by-mail policy has enabled out-of-state actors to circumvent Texas law. This federal legislation would close that loophole.
