* * * URGENT LEGISLATIVE ALERT 2/26/21 * * *

Urge House Speaker Dade Phelan and your Texas State Representative to support the Human Life Protection Act, HB 1280.

February 26, 2021

The Texas Legislature is meeting in Austin. Your calls or emails are needed to members of the Texas House to advance the Human Life Protection Act, HB 1280. (In the Senate, Lt. Gov. Dan Patrick has made it a legislative priority, and it will be refiled as SB 9 from SB 391.)

The Human Life Protection Act is an immensely strong pro-life bill to completely ban abortion beginning at fertilization. It could end legal abortion in Texas in a matter of months.

Please immediately urge House Speaker Dade Phelan to support this critically needed bill. Please urge your state representative to support it as well. Your two calls or emails could lead to saving the lives of tens of thousands of unborn babies every year in Texas.

BACKGROUND

    • Lt. Gov. Dan Patrick has made the Human Life Protection Act, SB 391, a legislative priority, and it will be refiled as SB 9. Here is our news release.
    • In the House, Rep. Giovanni Capriglione (R-Keller) is the principal author of HB 1280. Reps. Jake Ellzey (R-Waxahachie), Brooks Landgraf (R-Odessa), Dennis Paul (R-Houston), and Ed Thompson (R-Pearland) are co-authors.
    • In the Senate, Sen. Angela Paxton (R-McKinney) is the principal author of SB 391/SB 9. Sens. Paul Bettencourt (R-Houston), Dawn Buckingham (R-Lakeway), Donna Campbell (R-New Braunfels), Kelly Hancock (North Richland Hills), Eddie Lucio, Jr. (D-Brownsville), Charles Perry (R-Lubbock), and Drew Springer (R-Muenster) are authors of SB 391. Sen. Bob Hall (R-Edgewood) is a co-author.
    • HB 1280/SB 391/SB 9 coordinates with the Supreme Court (goes into effect) when and to the extent the Court overturns Roe v. Wade and Planned Parenthood v. Casey and begins saving lives as soon as legally possible. With the three new Trump appointed justices on the Court, that could be as early as this year.
    • The Texas Legislature is meeting at the Capitol in Austin through May 31 for the 87th Regular Session. They regularly meet every two years for 20 weeks. Now is that time.
    • If the Supreme Court changes its precedent and allows states to protect non-viable unborn babies, Texas needs to be ready with a new law to ban abortion to the extent allowable under the new precedent. The Human Life Protection Act is that new law.
    • Under the Human Life Protection Act, any person who performs an abortion (except to save the mother’s life) commits a first-degree felony. Any woman on whom an abortion is performed or attempted may not be prosecuted.
    • Ten states have passed essentially the same law: Arkansas, Idaho, Kentucky, Louisiana, Mississippi, Missouri, North Dakota, South Dakota, Tennessee, and Utah.
