Background

  • The Human Life Protection Act (HLPA) is the landmark law that completely protects unborn babies from abortion beginning at conception. The HLPA has a narrow medical necessity exception to allow abortions in rare and tragic cases to save the mother’s life or major bodily function.
  • Doctors may and are performing abortions in rare cases to save the mother’s life or major bodily function. Doctors have reported performing abortions under the medical necessity exception 151 times, an average of five per month. No doctor has been prosecuted, sued, or sanctioned for any of those abortions. No woman has lost her life for lack of an exception in the law. Here is our latest news release on those reports.
  • One of Texas Alliance for Life’s top goals is the passage of the Life of the Mother Act, SB 31/HB 44. That bill sets up Continuing Medical Education (CME) and Continuing Legal Education (CLE) about the critically important exception in Texas’ abortion laws, particularly in the Human Life Protection Act.
  • However, some pro-abortion advocates are calling for expanding the exception to other cases beyond those already allowed, including cases when the unborn child has a fatal diagnosis, which the Texas Alliance for Life strongly opposes.
  • However, pro-abortion members of the Legislature want to change that. There are more than 20 filed bills to expand that exception. The bills seek to allow abortions in a variety of ways, including when the baby has a fatal diagnosis, when the pregnancy resulted from rape or incest, for minor girls without parental consent, and many other reasons.
