Statewide Pro-Life Organization to Push Adoption of
Parental Consent for Abortion Bill in 79th Legislative Session

Restore Parents’ Rights To Protect Their Daughters

AUSTIN – Texas Alliance for Life announced today a parental consent for abortion bill one its top priorities in the 79th state legislative session.

"In Texas, parents have no right to intervene when a physician seeks to perform an abortion on their young daughter," said Texas Alliance for Life Executive Director Joe Pojman, Ph.D. "Abortion is major surgery and parents are left in the dark. We want to restore parents’ rights to protect the health and well-being of their little girls."

Texas law does not require abortion providers to seek parental consent before performing an abortion on minors, girls 17 years of age and younger.

"Virtually all medical procedures on a minor require a parent’s consent. That is the normal standard of medical care for minors," said Pojman. "In Texas, parental consent is required for a minor to get her ears pierced and a school nurse must get parents' permission to dispense aspirin to their child. Why should a major medical procedure such as abortion be different?"

Texas law currently requires abortion providers to attempt to notifiy parents that their minor daughter seeks to have an abortion. However, the notification law is inadequate. Parental notifications by phone or mail may never reach a parent or guardian because messages can be left at the wrong phone number or wrong address. The weakness in the law cheats parents out of their basic rights.

The proposed parental consent legislation would require an abortion provider to obtain written affidavit of a parent’s consent. A written affidavit is a binding legal document, and forgery is a serious offense under Texas law. Requiring parental consent would ensure that parents are being notified according to the law and gives parents the right to be involved in the healthcare of their children.
